3-Year Workmanship Warranty
Liberty Paving Inc. – 3-Year Limited Workmanship Warranty
Liberty Paving Inc. provides a 3-Year Limited Workmanship Warranty on qualifying residential and commercial asphalt paving installations. This warranty covers defects that are directly caused by defective workmanship performed by Liberty Paving Inc. and is effective from the date the installation is substantially completed.
This warranty is limited solely to workmanship and does not guarantee that asphalt will remain free from normal wear, environmental effects, or conditions beyond our control.
Warranty Coverage
Subject to the terms and exclusions below, Liberty Paving Inc. will, at its sole discretion, repair or replace the affected portion of the asphalt if it determines that a defect resulted directly from defective workmanship performed during the original installation.
Covered workmanship defects may include:
- Improper asphalt placement resulting directly from installation errors.
- Improper compaction resulting directly from installation errors.
- Improper workmanship that materially affects the structural integrity of the paved surface.
- Weed growth through the paved surface where Liberty Paving Inc. determines it resulted directly from deficiencies in the installation process.
Conditions of Coverage
This warranty applies only if:
- The paved surface is used for its intended purpose.
- The paved surface receives reasonable maintenance.
- The surface has not been altered, repaired, or modified by anyone other than Liberty Paving Inc. without our written approval.
- The customer notifies Liberty Paving Inc. in writing within the warranty period after discovering the alleged defect.
- Liberty Paving Inc. is provided a reasonable opportunity to inspect the work before any repairs are performed by others.
Warranty Exclusions
This warranty does not cover, and Liberty Paving Inc. shall have no responsibility for:
- Normal asphalt aging, oxidation, colour fading, weathering, or cosmetic appearance.
- Hairline surface cracking, minor shrinkage cracking, or normal thermal movement.
- Dry steering or tire scuffing.
- Ground movement, settlement, frost heave, expansive soils, sinkholes, or subsurface movement.
- Drainage conditions not specifically included within the original contract.
- Water damage, erosion, washouts, flooding, hydrostatic pressure, or drainage originating outside the paved surface.
- Damage caused by trees, roots, vegetation, or underground utilities.
- Heavy vehicles or equipment exceeding the intended residential or commercial use identified in the original contract.
- Improper snow removal, snowplows, skid steers, loaders, chains, metal blades, or other maintenance equipment.
- Oil, fuel, chemicals, solvents, de-icing products, or other contaminants.
- Damage caused by accidents, abuse, misuse, negligence, vandalism, fire, natural disasters, or acts of God.
- Utility work, excavation, landscaping, construction, or work performed by third parties after installation.
- Damage resulting from inadequate existing subgrade, unsuitable soils, or concealed site conditions that were not reasonably discoverable during installation.
- Areas where the customer declined recommended excavation, base replacement, drainage improvements, or other recommended work.
- Weed growth originating from edges, joints, adjacent landscaping, cracks caused by external conditions, or lack of maintenance.
- Normal wear from traffic.
Limitations
This warranty applies only to the original purchaser and is not transferable unless agreed to in writing by Liberty Paving Inc.
Liberty Paving Inc.’s total responsibility under this warranty is limited to repairing or replacing the defective portion of the original work. Liberty Paving Inc. is not responsible for incidental, indirect, consequential, special, punitive, or economic damages, including loss of use, loss of business, alternative accommodations, towing, landscaping, or other related costs, to the extent permitted by applicable law.
Colour, texture, and appearance of repaired asphalt may vary from the existing pavement due to normal weathering and aging.
Warranty Claim Procedure
To make a warranty claim, the customer must:
- Submit written notice describing the issue before the warranty expires.
- Include photographs and the property address.
- Allow Liberty Paving Inc. a reasonable opportunity to inspect the alleged defect.
- Not authorize repairs by another contractor before Liberty Paving Inc. has completed its inspection, unless immediate emergency repairs are reasonably necessary.
Failure to follow this procedure may void this warranty to the extent Liberty Paving Inc.’s ability to investigate the claim has been materially prejudiced.
Governing Terms
This warranty is the only express workmanship warranty provided by Liberty Paving Inc. Any implied warranties are limited to the maximum extent permitted by applicable law. If any provision of this warranty is found unenforceable, the remaining provisions shall remain in full force and effect.
